Direito Natural

Se não existe direito natural não existe sequer Direito ou direitos pela simples razão que a alternativa será que o Direito é tudo o que um grupo de pessoas ou uma maioria de todas, decidir a cada momento e isso significaria que não existe Direito nem direitos.

Um grupo de pessoas pode de forma voluntária ceder os seus direitos naturais a um processo de decisão colectivo.

Mas a legitimidade desse processo colectivo assentará sempre e apenas na vontade livre constantemente renovada de cada um em participar e submeter os seus direitos naturais a tal processo.

O que significa que cada um dos participantes tem a capacidade e direito natural a afastar-se de tal processo a qualquer momento e declarar que esse processo deixa de ter qualquer jurisdição sobre os seus direitos naturais.

Somos livres apenas e só porque temos direitos naturais acima de qualquer declaração colectiva.
